Hutton to appeal fine

LOCK The Gate Alliance national president Drew Hutton will appeal his fine over a coal seam gas protest at Tara, west of Toowoomba.

Mr Hutton said his barrister advised he could win an appeal against a $2000 fine imposed in Dalby Magistrates Court on December 8 for his part in a March blockade against a CSG pipeline on the Western Downs.

He risked a maximum $50,000 fine under section 804 of the Petroleum and Gas Act for "obstructing a CSG company without reasonable excuse".

Mr Hutton believes the case could set "an important precedent" for landholders looking to stop resource companies accessing privately owned land.

"The legislation says you need a reasonable excuse to stop mining companies from entering your land - we would like to challenge in legal precedent what that means," he said.

It's good to see Drew Hutton standing up to these gas companies. We need to have all the evidence that CSG will not contaminate our aquifers and that communities and landholders are fully informed about the risks associated with this practice and know what consequences they are likely to experience before they sign the CCAA. Our Government should be working for the people rather than for the mining companies.

Good on you Drew - stand up to these chaps.

From the experience I am having, these chaps have been bulldozing landowners for so long that when some one really stands up to them, they do not know what to do.

I presently have a company's $550 per hour lawyer stratching his head about what to do with an appeal that I have made to the Land Court stating evidence of how it has not made sufficient reasonable endeavours to negotiate with me regarding a Conduct and Compensation Agreement.

My advice to any landholder is to stand your ground and take them on with common sense agrument.
