AWB, ASIC settle privilege claims at 11th hour

THE Australian Securities and Investments Commission and wheat exporter AWB have agreed to settle claims for privilege by AWB in relation to transcripts of interviews conducted by ASIC in its oil-for-food investigation on the day that a High Court appeal on the matter was due to be heard.

According to The Australian Financial Review, AWB had sought access to the documents that were provided to former AWB managing director Andrew Lindberg in ASIC's civil penalty proceedings on the basis that they may contain material over which AWB claims legal professional privilege.

The parties also settled a separate dispute over documents in the Federal Court.
